This book explores a disciplinary matrix for the study of the law and governance concerning mining and minerals from a global perspective. The book considers the key challenges of achieving the goals of Agenda 2030 and the transition to low-carbon circular economies. The perspective encompasses the multi-faceted and highly complex interaction of multiple fields of international law and policy, soft law and standards, domestic laws and regulations as well as local levels of ordering of social relations.

What emerges is a largely neglected, unsystematised and under-theorised field of study which lies at the intersection of the global economy, environmental sustainability, human rights and social equity. But it also underlies the many loopholes to address at all levels, most notably at the local level – land and land holders, artisanal miners, ecosystems, local economies, local linkages and development. The book calls for a truly cosmopolitan academic discipline to be built and identifies challenges to do so. It also sets a research agenda for further studies in this fast-changing field.

Ana Elizabeth Bastida is Senior Lecturer at the Centre for Energy, Petroleum and Mineral Law and Policy at the University of Dundee, UK.

Editor Biography

Peter D Cameron is one of the world’s leading authorities on energy law. He is currently Professor of International Energy Law and Director of the Centre for Energy, Petroleum and Mineral Law and Policy at the University of Dundee in Scotland UK. Peter is a barrister (England & Wales, Middle Temple) and currently sits as an arbitrator in ICSID proceedings. Formerly he was a professor at the European University Institute in Florence and, prior to that, Director of the International Institute of Energy Law at Leiden University in the Netherlands. He has held visiting or part-time posts at the Universities of Oxford, Stanford, Singapore and Madrid (Autónoma). He is an honorary professorial fellow at Edinburgh University. He is the author/editor of fourteen books and almost one hundred articles. In 2013 Peter was elected as a Fellow of the Royal Society of Edinburgh.

Pieter Bekker holds the Chair in International Law at the Centre for Energy, Petroleum and Mineral Law and Policy at the University of Dundee and a Partner and Head of Investment Arbitration at CMS Cameron McKenna Nabarro Olswang LLP. He is Founding Director of the Dundee Ocean and Lake Frontiers Institute and Neutrals (DOLFIN) for research on law and science in determining maritime boundaries. Professor Bekker previously taught as a Lecturer-in-Law at Columbia Law School. He obtained basic and doctoral law degrees in Dutch and International Law from Leiden University and a Masters degree from Harvard Law School. A national of the Netherlands, he served as a staff lawyer in the Registry of the International Court of Justice (ICJ). He is an active member of the New York Bar and has served as counsel and advocate in cases before the ICJ, the International Tribunal for the Law of the Sea and arbitral tribunals charged with adjudicating investor-State disputes. Pieter is the author/editor of four books and over 100 articles on international law.
